Title IX and Sex Discrimination

What is Title IX?

Title IX of the Education Amendments of 1972 protects people from discrimination based on sex in education programs or activities that receive federal financial assistance. Title IX states:

No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance.

An institution that receives Federal funds must operate its education program or activity in a nondiscriminatory manner free of discrimination based on sex, including sexual orientation and gender identity. Some key issue areas in which recipients have Title IX obligations are: recruitment, admissions, and counseling; financial assistance; athletics; sex-based harassment, which encompasses sexual assault and other forms of sexual violence; treatment of pregnant and parenting students; treatment of LGBTQI+ students; discipline; single-sex education; and employment.   

  

What is Sex Discrimination?

Sex discrimination includes discrimination and harassment on the basis of sex stereotypes, sex characteristics, pregnancy or related conditions, sexual orientation, and/or gender identity or expression.

Discrimination is different treatment with respect to an individual’s employment or participation in an education program or activity based, in whole or part, upon the individual’s actual or perceived sex-based protected characteristic. This also includes allegations of failure to provide reasonable accommodations for pregnancy or related conditions.

Harassment includes Quid Pro Quo Harassment, Hostile Environment Harassment, Sexual Assault, Domestic Violence, Dating Violence, and Stalking.

On August 1, 2024, new Title IX regulations went into effect. Institutions of higher education are required to abide by both the previous and current regulations dependent upon when an alleged incident occurred. (If an incident occurred prior to August 1, 2024, the Title IX Coordinator will follow the  procedure in effect at that time.)
